The EBRD prohibits corrupt, fraudulent, coercive, collusive and obstructive practices, theft, and misuse of EBRD’s resources or assets ("Prohibited Practices"), which are committed or occur in relation to its assets or projects. The EBRD’s Enforcement Policy and Procedures sets out the policy and procedures for processing allegations of Prohibited Practices and for implementing enforcement actions, disclosure actions and mutual enforcement.
The EBRD’s enforcement proceedings follow a two-tier decision-making process.
As the second-tier decision-maker, the Enforcement Committee receives and determines appeals from the Enforcement Commissioner’s decisions, determinations, authorisations and non-authorisations in accordance with the EBRD’s Enforcement Policy and Procedures and the Enforcement Committee’s Terms of Reference. The Enforcement Committee decides cases either by a panel or, exceptionally, as a full Committee, depending on the complexity of the issues raised in the appeal.
The Enforcement Committee is composed of three external members (appointed by the EBRD’s Board of Directors upon recommendation by the EBRD’s President) and two EBRD staff members (appointed by the EBRD’s President). One of the external members of the Enforcement Committee is designated by the EBRD’s President as the Chairperson of the Committee.
The Enforcement Committee is assisted in its work by its Secretariat, which is appointed by the EBRD’s President.
